On the 21^st inst I rec^d a lot of Goods and no preparation having been made on my Store House during my absence and Knowing I could not get the building ready before the 2^nd Oct., likewise by deferring opening until that period of time I would avoid the provisional Tax of $50. I thought best to act in accordance thereto

In opening and marking the Goods ^with closed doors,^ in order to be ready to sell goods "Election" day some few persons, mostly Ladies insisted I should let them have few of the Goods part of which was Medicine and rather than give offense I compl-ied with their request. Some one or two persons learning of the circumstance from "personal pique" I think rather than for public Good insisted on the Sherriff compelling me to pay the Tax

and notwithstanding I had informed the Sheriff it was not my wish to open before 2^nd Prox^y for reasons heretofore sp-ecified yet rather than have any dis-sension or trouble in the matter and the Sheriff placed in a proper position I consented to pay the Tax with this un-derstanding I should lay the case before you for the purpose of having the same refunded in case your de-cision on the justice of my claim was in my favor

I have no disposition and trust never to cultivate one to evade paying any Tax duty enjoins and should your decision be averse to me I shall be satisfied that it is in accordance with your best judgment

Decatur Miss Sept 30^th 1865

The case as Stated above is in accordance with the facts W S Nimocks had a good Stock of Goods at Newton Station I called on him for the Tax as I was told he was selling although not well prepared He told me he did not intend to open until the 2^d of October—after my "first report"—as he States himself however I found he was Selling and did not feel at liberty to remit his Tax. W S Nimocks is doing a "business" at Decatur upon which His Excellency the Governor remitted the Tax on August last and in Consequence of this I presume the other Merchants were more determined that he Should pay and reported the fact of his Selling
