D^rSir—I have some habeas corpus cases triable before me on 23^d Inst, involving the Extend and proper construction of your certificate of Exemptions in favor of public officers, and to this ends I would be glad to have your own construction,

Some of the cases are presented by per-sons who are Selectmen or members of the board of Aldermen of Town-council of Kosciusko &other like corporations. Did you mean &intend to Exempt such?

I was inclined to the opinion that your certificate was intended to Exempt only those whose services were necessary to en-force and execute the State laws proper, or those upon whose official services depended in some respects the preservation of the state government and the vitality of the state laws, and not to Aldermen, Trustees of Schools, School Commis-sioners &c, altho they are quasi "public of-ficers and Elected in persuance of law."
