Sir

I am in receipt of your communication of the 8^th in regard to C. C. Byers and contents noted. The facts elicited on the trial of the lad were about to this affect. Byers was at work in Tishomin-go County Miss. and started to his home in Tennessee. soon after he crossed the State line he was seen in possession of the horse alledged to have been stolen.

He was riding the horse without a sadle and with a halter in stead of a bridle. when asked where he got the horse he stated that he got the horse from another man and gave a real name

of a person from whom he got the horse. Before he reached home he turned the horse loose in the woods, and the horse was found loose in the woods. I am inclin-ed to think that the facts in the case did not make a clear case of Lar-ceny. Admitting that his statement was false. I think that there is a strong presumption that he found the horse on the road-side and mearly intended to ride it near home and turn it loose—without any intention of converting the same to his own use. The horse ^when taken from the owner,^ was taken out of the woods.

The Boy had no witnesses sum-moned and could not procure any, as they lived out of the state. His parents are poor and could not help him. He had no friend or relative present at the trial. He was confined in jail for about 10 months before his trial.

He was quite young when the transaction hapened. I think he has ^had^ severe punishment already for a pitite larceny
