The State of Mississippi
Noxubee County

Be it remembered that a Circuit Court was begun and held in and for the County of Noxubee and State of Mississippi at the Court House in the town of Macon of said County on the 11^th,, day of October AD. 1869.

Present the Honorable John M^cRae presiding Judge of the Sixth Judicial District of the State of Mississippi, Present also C. A. Sullivan, District Attorney Pro-tem. Geo S. Smith clerk of said Court and R. C. Powers Sheriff of said County of Noxubee;

And among other proceedings then and there had; The Grand Jurors of said Court, through their foreman C. M. Thomas presented a true bill of indictment of which the following is a true copy to wit;

The Grand Jurors of the State of Mississippi elected, empanelled, sworn and charged to enquire for the body of the County

of Noxubee upon their oath present that W^m H. Warren late of said County on the 31^st,, day of July AD. 1869 in the County aforesaid, did feloniously, wilfully and of malice aforethought, kill and murder Henry Robinson, Freedman against the peace and dignity of the State of Mississippi

And among other orders & proceedings then & there had; a forfeiture was taken against said W^m,, H. Warren, of which the following is a true copy to wit:

This day came the District Attorney H. L. Muldrow, Esq: who prosecutes for the State and the defendant being solem-nly called to come into Court and answer the State of Mississippi of a charge of Murder, as he was bound to do, came not, but therein wholly made default—A forfeiture is therefore awarded against him, for the sum of One Thousand Dollars; And his sureties; W. H. Warren, W. G. Westmoreland, Lewis Green, J. H. Cason; J T. Long & W. H. O'Neal being solemnly called came not and failed to bring the body of W^m,, H Warren, into Court to answer the State of Mississippi

of a charge of Murder, A forfeiture was awarded them the said sureties in the sum of One Thousand dollars jointly & severally, It is therefore con=sidered by the Court that the State of Mississippi do have and recover of the defendant W^m,, H Warren the sum of One Thousand Dollars and of his sureties the said W^m H Warren, W. G. Westmoreland Lewis Green, J. H. Cason J. T. Lang & W. H O'Neal, the like sum of One Thousand dollars, jointly & severally, unless they show good cause on return of scieri facias, now ordered to be issued why said Judgment be not made absolute & final in this cause.

This day came the District Attorney; H. L. Muldrow Esq: who pro=secutes for the State, and on the motion of the district Attorney it was ordered by the Court that His Excellency; James L Alcorn, Governor of the State of Mississippi; be notified of the Residence of defendant in Pickens County Alabama, and that he be solicited for a requisition from the Governor of the State of Alabama, for said defendant; and that this cause be continued to next term;
