Dear Sir, you will see by rifering to the records of the Militia of Rolls of the State that at the Organization thereof, I was Elected to the office of Cap_t I did not seek the position, but insisted that the militia vote for some one subject, I took no part in the Election, in a word it ^the office^ was forced upon me, and as a Draft was ordered at the time as a matter of necessity I acted in the position of Capt merely for the benifit of the State—

I am Exempt by both State and Confederate laws, I am Postmaster at Kellis Store, and Justice of the peace of the northwest beat. of the County of Kemper, My health is Such that render me Totaly unfit for duty entirely a cripple from pains, and a Disease known as bloody piles, and can not Stand upon my feet to drill any length of time, even were I used in the tactics, we have a Mr Clark in our section who desires the office of Capt. quite a Military Man, has acted as Col in Kemper County. this you know, you have seen him many times in that position, the Company desires him as Capt—. again. Gen Davis assured me—that as I was Elected. that if I would act until the draft was completed, he would receive

My resignation and order an election^. for another, Since which time I have heard nothing from the 'Subject in consideration will you do me and the Compay of the Northwest beat—the favor of receiving my resignation, which will not only, be in my Judgement a Strict Complyance of ^with^ the Law^s but placing in Command a man well qual-afied to Instruct and Teach the men in the art of war—

P. S. I am a Sho maker, and have been following the trade for over two years, making shoes for the Soldiers, and remember they must have Shoes, and the orders I have to fill now consumes all my time for proof of this, you may learn, by refering to Capt Durham and Lieut, Chamberlain, a company of Ronoak prisoners now in your city, however the Shoes I have had to make for that Compay are complete, but for others, of which they know well,
