Whereas it is deemed of great importance in a military point of view and also necesary for the welfare & protection of a portion of the people of Mississippi who have suffered from the Raids & violence of the enemy, to rebuild the bridges and repair the track on the Mobile and Ohio Railroad between Okolona & Saltillo; and whereas the Legislature of Mississippi has by act approved the twenty sixth day of November 1863 author-ised the Governor of said state to enter into a contract with the Mobile & Ohio Railroad Company ^to^ carry into effect this desirable object, appro-priating for this purpose the sum of forty thousand Dollars Inper-suance of the authority confered by said act the following agreement is this day entered into.

The Governor of the state of Mississippi on behalf of said state agrees to pay the cost of rebuilding the bridges on the Mobile & Ohio Railroad between Okolona & Saltillo, and hereby authorites the Mobile & Ohio Railraod Company to draw for the same as fast as said bridges are put up; Provided, however, the amount shall not exceed twenty five thousand Dollars. And the Mobile and Ohio Com-pany in consideration thereof agrees to rebuild the bridges & repair the track between said points as fast as the labour & materials can be forwarded & the condition of the streams over which said bridges are to be built will permit; and as soon as said road is repaired, to run one train a day over said portions of said road unless prevented by accidents or raids in danger from the enemy or other Intifiable & reasonable causes. And the Railroad Company further agrees that if said State & Confederate armies & authorities should protect the bridges, roadbed, track and rolling stock on said portion of said Road from injury by the enemy and also from injury by the army and Soldiers of the State & Confederacy until the close of the war, and the Company should make any net profit by running said portion of road over & above cost of repairs and expenses of oper-ating the same, the company will pay ~~pay~~ back to the state the amount of said net profit up to the extent of the amount advanced by the State on said bridges if so much should be made. In writing whereof the Mobile & Ohio Company by Milton Brown President and the State of Mississippi by Charles Clark Governor have signed & mutually delivered this contract, in duplicate, this sixteenth day of December 1863.
