His Excellency Gov: Sharkey.
Jackson Miss:

Sir— [gap] On or about the 25^th Ultimo I had the honor of addressing you a letter from the Prison Hospital at Nashville Tenn: The uncertainty of postal commu-nication prompts me to send in matter a duplicate.

On the 20^th of June I made application for the benefits of the Amnesty proclamation of May 29^th 65 with the Amnesty Oath attached as prescribed.—It was forwarded through the regular military channel by advice of Maj Gen: Thomas Com^dg Dep^t who gave it his approval and recommendation. Some days after came notice of the additional requisite that papers of that description should be referred to the Governor of the State of which applicant was a resident. As the recall of my papers for purpose of reference would be attended with difficulty and loss of time I had the honor of asking your recommendation in my behalf as a detached paper. At the time of writing was a Prisoner of War confined to Prison Hospital at Nashville. Was disabled at the battle of Nashville /Dec 15^th 64) by loss of a leg.—Wound not yet healed—Am now a Prisoner of War on special parole, confined to limits of this town.

Am restricted from benefits of the Amnesty proclamation on two counts, the 3^d and 8^th—As was set forth in my application, responded to call of the Governor of the State of Mississippi for troops, on the 29^th of May '61 and was by him transferred to the Service of the Confederate States with the rank of Captain in the 17^th Miss: Reg^t on the 6^th of June '61—Was appointed Colonel of the 46^th Miss: Reg^t on the 11^th Dec '62—And a Brigadier General in the Confederate Army on the 1^st of March '64.—

On the 8^th exception—Was graduated at the U. S. Military Academy in class of 1841 and served in Florida War to its termination resigning on the 10^th of Oct 1842.—

At the commencement of the War was Superintendent of St Thomas' Hall, Military Institute at this place.—Have never appeared in political life and never filled a civil office.

Will be under favors for your recommendation to my application for the benefits of the Amnesty proclamation—Will be obliged if you will transmit it directly to the Department of War at Wash-ington. It is possible that you have already taken action, upon receipt of my former letter.

Cyrus W. Sears late a Brig. Genl. in Confederate Service, forwarded appli-cation for Pardon, through Maj. Genl Thomas while in Military prison at Nashville, learns that the "approval" of the Governor of his state is requisite, asks that the same be given & forwarded directly to Washington.
