On the 7th of August last I was elected Mayor of the City of Holly Springs. The returns were forwar-ded to the Secretary of State, as requir-ed by law. Up to this date, no commis-sion has been received

Although the Ordinance of the late Constitutional State Convention does not require the re-election of town and City Officers, still the question has been raised

As Mayor of the City, I am an ex-officio Justice of the Peace, and my powers, for that reason, are not confin-ed to the corporate limits of the City, but are co-extensive with the County.

Justices of the Peace are required to be elected at the coming October election.

I was elected under the Provis-ional Government by voters who had taken the oath prescribed in Johnson's Amnesty Proclamation.

Although I think no doubt should exist as to the legality of my election, still I desire to submit the matter to you. I do this for my own security, in order that my use-fulness as a Justice may not be impaired, nor my duties and rights questioned.

Will you please inform me if another election is necessary?

Was elected Mayor on the 7th of August last is ex-officio Justice of the Peace, does not think any doubt as to the legality of his elec-tion should be raised; but as the matter has been mentioned, desires to sub-mit it to the Governor; requests answer.
