I am in reciept of Senate Bill no. 348, and have exam-ined its provisions;

The act of Feby 18. 1867 is the first act authorizing a valid mortgage on personalty not in esse, and is an inovasion upon the common Law

The act of Apl 5. 1872,.as also the act of Apl 17. 1873 were amendatory explanatory and complicated, when construed with the former act, & hence

The act of October 22, 1873 repealed the act of Feby 18. 1867, And now this bill proposes to reenact, or to revive the act of 1867 as to the counties named in the act, which from the preamble of the bill, Seems to

be a necessity, and I see no objection to it, as it expires on the 1^st of October 1874.
