To the Sheriff of Hinds County—

Greeting:

Whereas at the December Term A. D. 1873 of the Circuit Court of Hinds County a forfeiture was taken against D. W. Jones ^An_d C. S. Bell surety, on the Bond of C. S. Bell indicted for "Shooting with intent to Kill," and whereas at the June Term A. D. 1874 of said Circuit Court of said Hinds County a "Nolle prosequi" was entered in said case, Now, Therefore I, A. K. Davis, Lieu^t Gov Actg Gov of the State of Mississippi by virtue of the authority vested in me by the Constitution of the State do hereby remit such forfeiture subject to the action of the State Senate at it's next regular session

To his Excellency the Governor and the Senate of the State of Mississippi:

Your Petitioners, C. S. Bell, and D. W. Jones, would respectfully show unto your Excellency, and the Senate, that at the June term, 1873, of the Circuit Court, in and for Hinds County, the Grand Jury found a true bill against the above named C. S. Bell, for shooting with intent to kill, and he surrendered himself and gave bond for his appearance at the June term 1873, of said court, with D. W. Jones, as his security. He appeared promptly and remained in court, from day to day, during the term, but his case was continued to the December term^1873,^ of said court, at which term your Petitioner, C. S. Bell, being then in Washington, D. C., and under Surgical and Medical treatment for a dangerous disease, he was unable to appear at the said December term of the said Circuit Court, as shown by the accompanying affidavits, which said affidavits failing to reach the court prior to its adjournment. Judgement of forfeiture against your Petitioners was taken by order of the said court.

Petitioner, C. S. Bell, having partially recovered from his disease, made his appearance in the said Circuit Court, and his case was disposed of by a nolle prosequi. Your Petitioners would represent that notwithstanding the case has been disposed of by a nolle prosequi, as afore said, the Judgement of the court still remains in full force against them, and your Petitioners are therefore constrained to ask that your Excellency, with the consent and advice of the Senate; as provided under Art. 5, Sec. 10, of the Constitution, will remit the forfeiture taken in this case against them, the said C. S. Bell and D. W. Jones.

Your Petitioners append affidavit explaining the cause of the non-appearance of the said C. S. Bell, at the December term, 1873, and also a transcript of the court records in reference to the Judgement of forfeiture against them, as well as the entry of the nolle prosequi in the case of C. S. Bell.

And your Petitioners will ever pray &c.

Having made a careful physical examination of Mr C. S. Bell I find that he is suffering from a bad case of fistula in ano which has recently been operated on, and I give it as my opinion that it would imperil his health and cause him great physical suffering were he to travel any distance in his present condition. The fistula is much inflamed and threatens stricture of the anus. Mr. Bell is now under my treatment and it would be imprudent for him to travel within a period of three or four weeks
