Please find en-closed a petition for the release of my son Henry ^Herron^ convicted at the April Term 1874 of the Circuit Court of Noxubee of the Crime of Bigamy and sentenced to Five years in the Penitentiary From the manner in which marital relations of the colored people have heretofore been conduc-ted and the mitigating circumstances con-nected with this case, I think the making of my son an Example and imposing the utmost rigor of the law more a hardship than the Equitable Enforcement of the law as,

To His Excellency the Governor of Mississippi

Your petitioners are citizens of said state, and respectfully show to your Excellency, That one Henry Herron who is now in the Penitentiary of said state, was tried at the last term of the Circuit Court of Noxubee County in said state on a charge of Bigamy—Convicted & sentenced to 5 years imprisonmt in the Penitentiary.

Your petitioners state that in their opinion & from all the circumstances—Said Henry was ignorant of the law—And we further state, that from the evidence, the first wife & said Henry were never lawfully married, but under the custom of the county were living together, at the time of the surrender, and laws passed since then made them as man & wife.

The said first wife left the said Henry Herron & refused to live with him. after living apart about 18 months—said Henry obtained marriage license & was lawfully married to another woman and as he states & we believe, without knowing he was violating the law—

We are of opinion that no serious damage has been done to any—nor has public morrals been seriously injured—& we think the penalty imposed was strangely great in comparrison to the offense committed—

We therefore respectfully

ask your Excellency to grant him a pardon and release him from said sentence, and your petitioners will ever pray &c—

Greeting:

Whereas, at the April Term, 1874, of the Circuit Court of Noxubee County, in said State, Henry Herron was convicted of the crime of Bigamy, and by the Court sentenced to Five (5) Years imprisonment in the State Penitentiary,

Now, Therefore, I, A. K. Davis Lieu^t Gov Actg Governor of the State of Mississippi, by virtue of the authority vested in me by the Constitution and Laws of said State, and for divers good and sufficient reasons, me, thereto moving, do grant unto the said Henry Herron a full pardon for said crime of Bigamy, and do authorize and direct you, on receipt of these presents, to release him from confinement.

In Testimony Whereof, I have hereunto set my hand and caused the Great Seal of the State of Mississippi to be affixed this 21^st,, day of September 1874.
