Westville, Miss, June 9^th, 1875

His Exccellency Gov. Ames

Dear Sir:

Yesterday Rufus Daily was convicted in the Circuit Court of this County of Grand Larceny. While he is technically guilty as charged, he has been severely and very cruelly tortured and whipped for the offence, besides having suffered imprisonment in the County jail for about twelve months, and I [unclear] recommend his immediate pardon by your Excellency.

Having been appointed by the Court to defend Rufus Daily I State that he had been worse abused prior to his delivery to the authorities than any one I have Seen Since the Close of the war and I endorse the above Statement of the District Attorney and Recommend his immediate pardon,

Rufus Daily was convicted at this term of the Court of this County of Grand Larceny. I sentenced him to one months imprisonment in the Penitentiary

I would gladly have released ^him^ from all punishment if it had been in my power to do so. I was informed that he was cruelly & inhumanly treated by the party from whom the property was taken and that he has allrady suffered more ~~than~~ punishment than it was in my power to inflict even if I visited upon him the full rigors of the law in the case If it was in my power I would discharge him at once

I heartily recommend him to executive clemency
