The undersigned your petitioners would respectfully represent that at the September term ^1874^ of the Circuit Court of Bolivar County Simon Daniels a Justice of the Peace for said county was indicted for Embezzlement in not reporting with his docket To the Grand Jury according to law the amount and number of fines collected by him since the preceding term of said Court

We would respectfully represent to your Excellency that up to the time of said indictments and since, the said Simon Daniels has borne the reputation and has conducted himself as an honest man and good citizen, that we beleive that he did not intentionally disregard the law ~~and that he after having~~

that he is poor with a large family to support and that he is not able to employ counsel without great hardship to himself and to his family—Therefore beleiving that the interest of the people of the state will be better subserved by his pardon than by ~~compelling him~~ permitting the prosecution to continue further, we would respectfully ask you to exercise the power vested by ^in^ you by the constitution in what we consider to be a really worthy case
