As attorney of Noxubee County, by direction of the County Treasurer, I brought suit to this court now in session, against W. M. Connor as Tax Collector on his official Bond. The County Treas-urer certifies that he owes the County about 23,000 besides damages I am ready to try the cause. The District Atty of this district refused to let his name be signed to the papers. After I had prepared the papers Mr M^cMichael comes and demands the control of the ^case^ under the act of 4^th March 1875. His atty Col Dowd comes into court and moves that he has the right to control the case, and that he has on private examination found the sheriff

only indebted 4,000—and now moves the court to settle it In [?] against him for that amount upon [?] motion—without a trial before the County ^Court^ in which this case is now pending. The Prest of the Board requested me to write to you on the subject. I think the county has the right to pro-ceed with the case, and that your appointee has no right to take the control of the case, and settle on his own terms. They have given me no opportunity to exam-ine the settlemnt made by them. It it is just and right the court could now settle the matter and there would be no trouble But the Board of Supervisors nor the County Treasurer do not believe the settlemt just & correct

But they honestly believe that said Connor owes the county at least $22,000 for Taxes for the year 1874. The time for his final set-elmt for the Taxes for 1874 was by [?] on the 15 dy of April 1875. The suit was brought for the first time after the 15^th April 1875. Shall County yield up this case to M^cMichal appointed und the act of March 1875. I think he can [?] trial and settle [?] transpiring ^six years^ pryor to 4^th March 1875, and not those trapiring after that day.
