Macon Miss Oct 18^th 1875

Gov. A Ames

Dr Allgood will hand you this. I am the County attorney. The suit I brought in favor of the County against Tax Collector W. M Connor for about $23,000 was not tried at our last Court. I was ready for tryal, and claim that under the Statute it was a prefesenl case and tryable at the [setond?] Term of the Court, see Rev Code 1871 Sec—

But the Court decided otherwise and contin-ued the case.

At the request of Dr Allgood I have to say that the Grand Jury on the last day of the term, brought into Court two bills of Indictment against the Dr for Perjury. He did not fear the result, and I as his atty in open Court demanded a trial forthwith. The Court Stated the Jurors had been discharged. I then demand and asked that a Jury might be forthwith summoned to try the cases, which was refused by the Court, and the cases continued. The Dr being a candidate for Sheriff was anxious to dispose of the cases before the

[Political elections--Mississippi|election]], as he felt that these prosecutions were gotten up to break him down and to defeat him. I think so, and believe that they are groundless Thus believing he and I both wished to test the cases at once; and relieve him from what we regarded as persecution.

I am not of the party to which the D^r belongs But I thought ^it^ but justice and right to say this much.
