Before me the Undersigned Clerk of the Circuit Court of said County this day personally Samuel Sin-gletary who upon being by me duly sworn deposed and says as follows—to wit: I was indicted and tried jointly with my brother Hect. Singletary and convicted at the November Term of the Circuit Court of said County for stealing a certain cow the property of one Wilson James.—My brother Hect. Singletary although convicted with me and although there were sus-picious circumstances against him is entirely innocent and had nothing to with the taking of said cow.

We lived in the same house and after the cow was killed I took some of the meat to Hector and asked him to put it away for me—Not telling him where I had gotten it. This was the meat found in his possession by the Constable who made the search. I am

satisfied that what Hector did and said when the Consta-ble came with the search war-rant was all intended to shield and aid me;

Having been convicted I am willing to serve out my sentence but as my brother is innocent I am unwilling that he shall suffer with me. & I desire that this my statement of the truth shall go to the Governor with a petition for Hect. Singletary's pardon.
