The Trial of T. W. Cardoza, State Super-intendent of Public Education.

First Day

Senate Chamber Saturday February 11^th_" 1876

At 12 1/2 P. M. M^r Gray moved that the Senate do now proceed to organize as a Court of Impeach-ment and that a committee of two be appointed to wait upon and request one of the Justices of the Supreme Court to attend the Senate and administer the prescribed oath to the Senators present.

Which motion prevailed.

Thereupon the President pro tempore of the Senate announced: that The Legislative and Executive business of the Senate will now be suspended and the Senate will be organized into a Court of Impeachment to consider the matter of the Impeachment of Thos. W. Cardoza, State Superintendent of Public Education

Messrs Taylor and Terry were appointed as a committee to wait upon and procure the attendance of one of the Justices of the Supreme Court to administer the oath to Senators.

In a few moments, M^r_" Justice Tarbell, Associate Justice of the Supreme Court of the State of Mississippi escorted by the committee, Messrs Taylor and Terry, entered the Bar of the Senate.

will now be administered to each of the Senators present. As the roll is called by the Secretary, each Senator will answer to his name and rise and stand at his place. The Secretary will call the roll.

The Secretary proceeded to call the roll alphabetically, and M_r Justice Tarbell administered the oath to Senators Allen, Albright, Barry, Callicott, Carter, Chalmers, Everett, Fewell, Fitz Gerald, Foote, Furlong, Graham, Gray, Griffin, Hooker, Johnston, ~~M^c~~M^cCackill, M^cNeil, Mendenhall, Metts, Morgan, Oldham, Reynolds, Shirley, Sims, Stewart, Stone, Taylor, Terry, Thompson Thornton and White, in the words following:

I do solemnly swear that in all things appertaining to the trial of the impeachment of ~~Alexa~~ Thos. W. Cardozo, State Superintendent of Public Education, now pending, I will do justice according to law and evidence: So help me God.

The Secretary was ~~instructed~~^directed^ by the President pro tempore, to inform the Managers on the part of the House that the Senate is now organized as a Court of im-peachment and is ready to proceed with the trial of the Impeachment of T. W. Cardoza State Superintendent of Public Education.

In a short time the Mangers on the part of the House were announced by the Sergeant-at-arms.

President pro tempore: The Mangers of the Impeachment will advance within the Bar and take the seats provided for them.

Thereupon Messrs Man^agers R. S. Hudson, G. D. Shands ^J. G. Hall^ and J. E. Leigh, came within the Bar and took the seats assigned them in the area in front of the Chair. M^r Manager M^cNair was absent.

President pro tempore. Messrs Mangers. The Senators present having been sworn according to law and being in all respects duly and Constitu-tionally organized as a Court of Impeachment, is now ready to proceed with the trial of the impeach-ment of T. W. Cardoza, State Superintendent of Public Education

M^r Man^a^ger Shands: M^r President. We are instructed by the House of Representatives, as its Managers, to demand that the Senate take process against Thomas W. Cardoza, Superintendent of Public Education of the State of Mississippi, that he may answer at the Bar of the Senate upon the articles of Impeachment heretofore preferred by the House of Representatives by its Managers before the Senate.

President pro tempore: Orders will be taken by the Senate.

By M^r Taylor: Ordered: That a writ of Summons issue to Thomas W. Cardoza, Superintendent of Public Education, reciting the articles of Impeachment preferred by the House of Representatives against him, and

containing a copy of said articles, and notifying him to appear before the Senate on Tuesday March 14^th 1876, at 10 1/2 o'clock A.M. at the Senate Chamber in the city of Jackson, and file his answer to to said articles of Impeachment, and to stand to and ~~answer~~ abide the orders and judgments of the Senate thereon.

Absent and not voting [Messrs] Catchings, M^cClure, Mendenhall, Pratt, and Smith—5

The Managers on the part of the House then retired.

M^r Reynolds: I move that the Senate, sitting upon the trial of the Impeachment of T. W. Cardoza, adjourn until Tuesday next the 14^th_" Instant, at 10 1/2 oclock a.m.

The motion prevailed and the President pro tempore thereupon declared the Senate sitting for the trial of the Impeachment aforesaid adjourned to the time named, and the Senate resumed its Legislative business
